A Notice of Seeking Possession Order is the mechanism by which a landlord can apply to the court to gain back possession of a tenant's home if they fail to comply with the terms of their agreement i.e. a legal document issued at the first stage of eviction. Based on the grounds for eviction, individual ASB notice type parameters can be created and linked to an appropriate 'effective rule' to determine the duration over which a tenant has the opportunity to respond before a court action can be processed. Once a notice has been issued, the assigned 'expiry rule' governs the period over which action can still be taken if subsequent commitments are broken.
The procedure to define an ASB notice type parameter value is as follows:
- Navigate to Quick Menu > ASB > Configuration > Notice Type. The Notice Type Configuration window is displayed.
- Click on New Notice Type
1. All fields are activated ready for data entry.
- Using the Classification drop-down field, select the specific parameter value of ASB.
- Enter a Description for the ASB notice type into the field provided

- Using the Companies drop-down field, multi-select all companies for which this ASB notice type is relevant, or choose the All option, as required

- Select the Communication Definition to be employed on serving this ASB notice type using the corresponding spy-glass icon (
). The Communication Search window is displayed, ready to locate the desired communication: (a) Enter sufficient communication definition details into the search fields provided; (b) Click on Search - The Communication Search Results window is displayed, returning all possible matches; (c) Activate the Select tick box against the row containing the exact record match or use Refine Search to enter alternative criteria; (d) Click on Confirm.
- Using the Effective Rule drop-down field, select an appropriate operating period for this ASB notice type before court action can commence i.e. Notice effective immediately, 7 days after next period start, 14 days after next period start, 28 days after next period start or Calendar month after next period start.
- Using the Expiry Rule drop-down field, select an appropriate parameter value to reflect the elapsed period before an active notice expires i.e. 12 months after effective date or 52 weeks after effective date.
- Choose an Effective from date for this ASB notice type i.e. the date on which the parameter came into effect

- Choose an Effective to date if the ASB notice type parameter status is to be reviewed on a specific date or to capture a change of circumstances; a blank field means the notice type will never expire.
- Click on Save

Tip
1 Where only a small number of parameter values are not required, activate the All tick box first and then deselect individual items from the full list, as required; the All tick box will be automatically removed once an item is deselected.
Note
1 Upon first access, all fields are automatically activated ready for data entry; hence the New Notice Type button is inactive.
2 System validation rules ensure that the description entered for each new notice type is unique for the effective period.
3 The Effective from date defaults to the current system date and cannot be left blank.
4 To amend the details of an existing parameter, expand the ASB classification and select a notice type from the alphabetical list, or enter its name into the Search Notice Type field. By default the list is filtered to show Current notice types. An alternative filter can be applied using the Select view drop-down field: Expired, Future or All combinations. Only a limited number of fields can be updated once a record has been created.
